Working Outside of Tianjin Juilliard Policy

Applies to: non-Chinese-national faculty (“Expatriate Faculty Member” or “Faculty Member”) who wish to engage in performing and teaching outside of The Tianjin Juilliard School ("Tianjin Juilliard” or “School").

Expatriate Faculty Members may engage in performing and teaching activities outside of Tianjin Juilliard, only if (i) s/he has obtained the prior written approval of School; (ii) his/her external activities outside of School would not affect the faculty member's normal academic activities and work at School; and (iii) Tianjin Juilliard has entered into appropriate contract(s) with the third party, except for permitted external activities outlined in this Policy. Without meeting the aforesaid conditions, Expatriate Faculty Members cannot engage in such activity and identify their external activities as Tianjin Juilliard activities.

Approval Process
Expatriate Faculty Members should download the “Short Term Absence/Working Outside of Tianjin Juilliard” application form located on Sharepoint and email it to the Artistic Director and Dean, with copy to the Assistant Dean of Performance Activities, Performance Manager as well as the Associate Dean of Academic and Student Affairs, and the Pre-College Administrative Director should the absence include a Pre-College teaching day. Requests to approve outside performing or teaching activity should be sent at least one month ahead of the engagement.  The email application needs to specify the following items of the external activity:

•    Date 
•    Venue
•    Name of the inviting organization
•    Contact person of the inviting organization (such as email or WeChat ID)
•    Nature of the outside activities
•    Fee if applicable
•    Additional information about transportation and hotel, if applicable.   

Under PRC laws, expatriate employees are not permitted to work for a company that is different from the company as stipulated in his/her work permit. In order to mitigate potential risks, Expatriate Faculty Members cannot sign contracts with an external festival or organization on their own. The Tianjin Juilliard School must enter into a contract (“Tianjin Juilliard Contract”) with an external festival or organization on the Faculty Member’s behalf. The consequences of not following these regulations may result in his/her being deemed as illegally working in China and in his/her work permit being revoked.

Once the Expatriate Faculty Member has obtained approval for his/her outside work, the Performance Manager will act as the School’s representative to help Expatriate Faculty Members communicate with the inviting organization and handle the relevant contracts and payment issues. If the presenting organization has not signed the Tianjin Juilliard Contract 15 days before the outside teaching or performing activity is scheduled to commence, approval for the outside activity may need to be withdrawn. Upon approval of the absence, the Performance Manager will forward a copy of the signed application form and where applicable, the associated service contract to the Office of Human Resource for record-keeping and relevant procedural formalities.


External Activities 
Work outside of Tianjin Juilliard must be coverable under one of the contracts outlined below. It is the Expatriate Faculty Member’s responsibility to explain to external organizations that they must sign a contract with Tianjin Juilliard in order for the faculty member to engage in work outside of Tianjin Juilliard. If the presenting organization is not willing to enter into a contract with Tianjin Juilliard, it will not be possible for the faculty member to perform the concert, even forgoing a fee. If the presenting organization will not agree to sign a Tianjin Juilliard Contract, the faculty member must consult with the Artistic Director and Dean, and the Performance Manager.

The following types of external activities must be processed and entered through a contractual agreement between a presenting organization and Tianjin Juilliard:

•    Engagements or services that take place in China including Hong Kong, Macau and Taiwan, other countries and territories, and are organized and paid by Chinese entities
•    Engagements or services that take place in China, but are organized and paid by non-Chinese entities

External activities conducted outside of China and paid by non-Chinese entities are not covered by this Policy, and not subject to prior approval to Tianjin Juilliard provided that such activities do not conflict with the Expatriate Faculty Member’s responsibilities at Tianjin Juilliard. If the faculty member is engaged by a non-Chinese organization for services rendered outside of China, the Faculty Member must ensure that the compensation is paid to a bank account outside of China.

Performance Practice Contract 
•    Unpaid work: For unpaid performing activities, any travel and lodging expenses that may be incurred for the Faculty Member by the presenting organization must be documented in a Tianjin Juilliard Contract.  

Training Contract
If the external activities are teaching lessons, coaching chamber music or other teaching activity at a festival or workshop; giving a masterclass that is not part of Tianjin Juilliard recruitment activities; serving as a juror for a competition as well as lecturing or doing a presentation that is not organized by Tianjin Juilliard, a training contract would apply. The training contract can be paid provided that it is a Tianjin Juilliard Contract and these activities can be viewed as falling under the Faculty Member's job responsibilities as set out by Tianjin Juilliard. The maximum payment is RMB 15000 per day.

Some outside work situations may require both the Performance Practice contract and the Training contract. An example of such circumstance would be the participation in a festival where the Faculty Member is teaching as well as performing.

Note: In the event that a Faculty Member agrees not to accept payment for participation in any of the above activities, s/he must still inform the Artistic Director and Dean and the Performance Manager about this outside work so it can be determined whether a training contract is applicable.

A training contract is not required to teach consultative lessons to a prospective student on behalf of Tianjin Juilliard. Ex-pat faculty can only teach non-enrolled students (those not enrolled in the Pre-College or Graduate divisions) through consultative lessons in the Tianjin Juilliard Public Education division as stipulated in the Private Teaching Policy in the Faculty Handbook. If the Faculty Member is approached about teaching a consultative lesson, the Faculty Member must contact the Office of Admissions.


Taxes
All payment the Faculty Member receives for outside work will be taxed. The amount of the Faculty Member’s fee will be a pre-tax amount from which VAT and IIT will be deducted. The VAT tax and related surcharges can be calculated at approximately 7% of the Faculty Member’s service fee; IIT tax is calculated according to the Faculty Member’s total earnings to date within the calendar year including both the Faculty Member’s annual salary from Tianjin Juilliard and the Faculty Member’s extra earnings.
